How to File for Bankruptcy in Australia

Are you struggling with personal debt? Have you explored all your other options and believe that bankruptcy is the most appropriate solution for you? Then read this article that will tell you how to file for bankruptcy.

First, you need to appoint a Bankruptcy Trustee. You have two choices. The first is to go with the Official Trustee (a government body known as Australian Financial Security Authority, or AFSA). Alternatively, you can enlist the assistance of a private Registered Trustee of your own choice. To do this, you will need to search for a Registered Trustee that you feel comfortable with and trust to handle your financial affairs.

Next, you need to complete the following forms:

● Debtor’s Petition: Which states your request to claim bankruptcy
● Statement of Affairs: Which is a large form that details your current financial state and affairs
● Any other required supporting documentation

If AFSA is your Bankruptcy Trustee, then you can directly lodge your application with them. If you have chosen to appoint a private Registered Trustee, however, then he or she needs to add their own Consent to Act to it.

Now that you know how to file for Bankruptcy in Australia, it is important to note that it is recommended that you enlist professional help from an expert to help you complete the required documentation.
