Can I Travel Overseas If I’m Bankrupt?
If you are bankrupt, or are considering bankruptcy, you may be wondering if you are able to travel overseas or not.
The answer is yes, you can travel overseas whilst bankrupt, but you must first obtain permission from your Bankruptcy Trustee. This includes if you need to travel urgently or for compassionate reasons.
You will need to complete a “Request for Permission to Travel Overseas Whilst Bankrupt” form.
You will also need to discuss the following concerns with your Bankruptcy Trustee before they grant you permission, including:
- Who will be paying for the trip or how it was funded;
- Whether or not there are conditions on your travel. This can include paying outstanding compulsory income contributions prior to travel. In some cases, you might need to pay a bond before you travel.
For travel within Australia or to Australian islands and territories (e.g. Norfolk or Christmas island), you do not need to seek your Bankruptcy Trustee’s permission.
It is important to note that your trustee can refuse to give you permission to travel.
