What is a Bankruptcy Trustee?

A Bankruptcy Trustee is someone who is qualified to handle and oversee Bankruptcy cases and Personal Insolvency Agreements. They have to be registered with the Australian Financial Security Authority (AFSA), complete the minimum level of studies and have experience in dealing with related matters.

In order to be qualified by AFSA, a Trustee needs to:

  • Hold a university degree majoring in accountancy
  • A member of the Institute of Chartered Accountants or CPA Australia

It is also preferred that they be a member of ARITA, which stands for the Australian Restructuring Insolvency & Turnaround Association.

To ensure that a Registered Trustee maintains his or her high standards even after being registered, AFSA conducts an annual inspection of their file.

They have multiple responsibilities in a Bankruptcy case such as:

  • Telling your creditors that you are bankrupt
  • Collecting all divisible assets to repay creditors
  • Taking the appropriate steps to recover property
